SEC. 183. DRIVING AT EXCESSIVE SPEED.

Whoever drives a motor vehicle in contravention of the speed limits referred to in section 112 shall be punishable with a fine which may extend to Rs. 400/-, or, if having been previously convicted of an offence under this sub-section is again convicted of an offence under this sub-section, with fine which may extend to Rs. 1000/-
SEC. 185. DRUNKEN DRIVING OR DRIVING UNDER THE INFLUENCE OF DRUGS.

Whoever, while driving, or attempting to drive, a Motor Vehicle, -
(a) Has in his blood, alcohol exceeding 30 mg. /per.100 ml. of blood detected in a test by a breath analyzer, or
(b) Is under the influence of a drug to such an extent as to be incapable of exercising proper control over the vehicle,
Shall be punishable for the first offence with imprisonment for a term which may extend to six months or with fine which may extend to Rs. 2000/-, or with both; and for a second or subsequent offence if committed within 3 years of the commission if the previous similar offence, with imprisonment for a term which may extend to 2 years or with fine which may extend to Rs. 3000/-, or with both.

in Mumbai western express highway there is lapse of to follow lane rules........
we have observed A truck , Dumper , Rick show , Bike.....driving on right lane.........where we understand this right lane is only for car vehicle.......why traffic police not forcing them to follow lane rules.........

due to these most of the time western express highway remains Jam mainly at Goregaon , Andheri.....Malad....

in many cities of India`s different state.....heavy vehicles are not allowed between 8 A.M. to 8:00 P.M
Why such rules not for Mumbai W.E.H ?

No one can paste any type of film on any of the glasses of a vehicle. The allowed VLT of 70% and 50% has to come in the glass from the manufacturer. It means if anyone wants to apply any tint they have to get there glasses changed with VLT of 70% for front and back & VLT of 50% for side glasses. No kind of film can be put/pasted on any of the glasses and it has been clearly defined in the SC judgement.

Under MV Act 1988 it is necessary to carry originals and it is the responsibility of the driver to carry them.

I have a situation! Few months ago, I was fined by a Officer in Uniform for Talking on Phone while driving, I took a receipt and they took away my License telling me that I have to go to the RTO office within 10 Days and pay the fine, I will get my License back. On 3rd day I went to the respective office and showed them receipt, the officer on duty asked me to pay Rs.1700/- and come after 3 days to collect my MDL. I asked him to give me receipt for 1700/- but he refused. I asked him further procedure, so he told me that I will get a summons from court on a address printed on MDL, then I need to go to court, pay the fine whatever court ask me to pay & then I will get my MDL. But since then I haven't get any summons. Its been 9 months! I have been charged for Driving without MDL several times, but no one gave me proper procedure information about how do I get my MDL back! Please help! Also if you can, please let me know the procedure for paying a penalty for any offense!

Penalty for offense can be paid at the traffic police mentioned in the challan or court if mentioned so. What you should is give a written complaint addressed to the Inspector of the Traffic Police Station and you can send a copy of it(do mention Copy To: in the letter to the inspector) to the Jt. Cp for prompt resolution of your issue.

Where can one look at the history of offence of drunk driving in Mumbai and for how long does the name of the person convicted but not sentenced, but only fined stay in records. Does it get removed after some years?

Sorry, this information is not available with me. As far as the police system is concerned every violation is recorded in papers. A record normally does not get removed from papers as there is no provision for it.

Penalty is Rs 100 first time. If the rule is violated for the second time, the penalty will be Rs 300 while for the third consecutive violation, it will be Rs 300 and the driving licence will be suspended.

On 31st Dec2013 Police were checking all the vehicles,I haven't broken any rule, but I didn't have any documents police took my License, given a receipt and told me to produce the documents and pay a fine of Rs100/- and collect the License.
My PUC and Insurance was expired, I purchased the Insurance and PUC on 4th Jan2014, Police aksed me to pay a fine of Rs1600/- for both Insurance and PUC.
One of my friend told me that we can purchase the Insurance and PUC within a week. and can produce to traffic police, the fine will be only Rs.100/-.
What is the exact rule.

Insurance is compulsory and if you do not have it you can be fined the full amount for it. For PUC one week relaxation is available. Rs. 1000 is the fine for Insurance.

Once i was caught by city police (Constable) in charge of using phone while driving. He asked me to pay a fine of Rs.500. I asked him to charge some less and i refused to pay 500. Constable was taking me to police station for this - he drived my bike even.

Does city police have such rights ?? under which section if yes
please guide

Fines are not negotiable and your vehicle can be seized. Since a constable does not have the power to raise a challan he can take your vehicle to police station or ask you to wait till a officer of sub inspector level comes. Disobedience can lead to higher punishment.

Hi Rohit, first of all I would like to applaud your efforts for providing so much clarity. I would be grateful if you could assist me with a couple of doubts.
1)You mentioned fine for PUC is Rs. 1000/- after 7 days. But 7 days from expiration of last PUC or 7 days since the cop catches you. eg if my last PUC expired six months back and cop catches me yesterday and I renew it today. What is the fine?

2) If the cop confiscates my license and asks me to go to court, can I compund it in any way? As in can i pay the fine at the police chowkie the next day instead of going to the court?

It is 7 days after a cop checks you. If you reproduce PUC within 7 days then fine is not applicable.
No, if he asks you to go to court the fine is decided by the court.

Hi wanted some clarification on the new rule about Film
1) what is is the difference between films of 70/50% visibility and the Tinted glass having similar visibility.
2) was there any awareness drive by the police in the city where they informed people about the rule.
3) how will it be known/decided whether my offense to drive in a car with films is 1st or 2nd and fine amt accordingly
4) if we are not able to go to chowki to collect the license with in 10 day from where can we subsequently collect it and what are the fines
5) I am traveling out of Mumbai for a project and will not be returning at least for a year - so in this case how do i manage to get my license. and what will be the situation and fine if I collect my license after a year

My Friend was riding my bike in Mira Road when a Police not a traffic police held him for general checking. And my friend said that the cop charged for not having original papers in bike. Now I have been riding for more than 10 years and having used this bike for more than 4 years, no cops who stopped for general checking told me that it is a offence. So just want confirm is it an offence to not carry originals in the bike?

Hi, Please find them below:
1) An Indian citizen filed a petition in SC for ban against films on vehicles, while Sc did not change the rule but highlighted a rule in MV Act 1988 which states that nothing can be pasted on glass of a vehicle and also ruling that tinted glasses can be put up on vehicle. Films cannot be pasted on the glass of a vehicle and a vehicle can be fined for it. 70%/50% tinted glasses can be put up. 2) Yes, it was widely covered in media, publicized by Traffic Police of all cities in India in May 2012 and for three months thereafter because the judgement from SC was very strict that all heads of police will be in contempt if the rule is not enforced strictly. 3) Order of SC is to fine the vehicle and remove the film on the spot. Traffic Police can fine multiple times for the same offense.
4) You need to inquire it at the chowki. It can be collected at the chowki only.
5) In such situations license are normally misplaced, so its always best to collect it at the earliest.
6) VVIPs who have been given Z+ security are exempted.

Originals have to be carried while driving as during an offense/police-case originals are seized by the police.

A few days ago I had parked my two wheeler on Station Road,Wadala, under the mono rail in the centre, as it is a general practice since all the citizens staying in that road park in the same way.
My 2 wheeler was parked under the mono rail in the centre of the road where many 2 wheelers and 4 wheelers are parked being a general practice towed away and when I told them there is no sign board showing No parking then on what basis did they towed or not even a constable is there to help citizens about it.
They told me since 2 wheeler was and it is a no parking zone and we do not have to put up a sign showing it as a no parking zone. Can you pls. help me aboout the rules as If I am not at fault I plan to fight it out.

Designated Parking Zones are defined by a Parking board and any public area without no parking board is a no parking zone.

First question : are white lights illegal ? If yes ( as i confirmed with a traffic inspector ) i tried complaining to the RTO about a few license plates i noted down. Sadly neither their phone no. , or their email address or their online complaint facility works. NO PHONE OR EMAIL WORKS. Please see to it that they have it corrected and working asap.

what do u think should i do pay the fine and collect my license or wait for court date and go thorough all that?

Yes they are, any modification to a vehicle has to reported to RTO via a application form. Sadly govt. departments still work on paper, I suggest you write a letter to top official and send through post for action.

You need to obtain a local registration of the vehicle for which you need to approach RTO. Pay the road tax at Mumbai and claim refund at Gujarat for remaining period of road tax. Road tax is paid for 20 years and refund will be for the remaining duration.
Before approaching RTO at Mumbai, you need to obtain NOC from Gujarat City Police where the vehicle is registered.

Hi Rohit. I read that the fine for not wearing a helmet is Rs.100 for first time offence, the cop ask me to pay Rs.500 or he would confiscate my licence & then I would need to pay Rs.1500 at a police station! When I agreed to pay Rs.500, he didnt give me any receipt saying that it was only bribe & not the original fine amount! So when I asked him for original amount for the Penalty, he asked me to go away before he charges me for 'Arguing with a police officer'! Please Clarify

Now i came to know that why India is very corrupt country.
Because of some police officers.
Today I got caught one traffic police I've shown him licience and all papers then check my horn. Its little bit loudly Officer said me that this is pressure horn you don,t have permission of wise this horn i said that iam living in a very rush area so this horn is very useful for me to clear the publics on road.He said me that you have to pay find of one thousand Rs/ I said i don't have that much money he took my licence with him and give a reciept now look sir we middle class people how can we arrange such of 1000 rs/ i have 8,000 Rs/ per month what to do sir.But he said me that you give me 300/Rs ill give your licience.Now see deffrence sir where is thousand and where is three hundread.

Thanks for the kind words. The procedure is that court asks if you were in violation of the offense, if you are in violation accept the offense and pay the fine at the court. Normally in such cases you do not even require a lawyer until you plan to contest the challan.

Is it true that if we forget to take our vehicle paper or license and if the traffic cops charge fine for that. Immediately we don't have to pay the fine if we won't pay he may charge some other fine. I have heard that we can show our paper and license in 15 days and no need to pay fine.

I jumped a signal today at borivali west. And the police officer charged me with rash driving which I was not. Argued with him on this and he told me he will charge me further and took away the license. His seniors were there told them about him but they also didnt answered. Where can put my grievances as I have lost my faith today totally from this police persons.
